1.1. Applicable regulations

This Privacy Policy has been designed in accordance with EU General Data Protection Regulation 2016/679 of 27 April 2016 (GDPR), and applicable Spanish data protection legislation.

Accessing and using this website implies awareness of this Privacy Policy. The processing of your personal data is based, depending on the specific purpose, either on handling the request you make yourself or on the express consent you give through the relevant checkbox on each form. Submitting a form does not, by itself, imply consent to any processing other than what is strictly necessary to handle that specific request.

The Company may amend this Privacy Policy to adapt it to legislative or case-law developments, or to guidance issued by the Spanish Data Protection Agency. These terms may be supplemented by the Legal Note, the Cookie Policy, and any specific terms established for particular services.

2. Purposes and legal bases of processing

We process your personal data for different purposes, each with its own legal basis:

  • Enquiries and information requests (contact form, property valuation request, call request, enquiry from a property listing page): the purpose is to handle and respond to the specific request you make. The legal basis is the handling of a request made at your own initiative, in accordance with Article 6(1)(b) GDPR (steps taken at the request of the data subject prior to entering into a contract), and no additional consent is required for this processing.
  • Newsletter and commercial communications: the purpose is to send you news, updates, offers or commercial information about our activity. The legal basis is, in every case, your express consent, given through an independent, specific, unticked checkbox, in accordance with Article 6(1)(a) GDPR. This processing never happens automatically as a result of submitting an enquiry form.
  • Managing the contractual relationship, should you go on to engage our services: legal basis is the performance of the contract, in accordance with Article 6(1)(b) GDPR.

2.1. Data retention periods

Retention periods vary depending on the purpose of the processing:

  • Enquiries, information requests and property valuation requests: kept while your request is being handled and for up to 12 months from the last interaction with you, unless the enquiry leads to a contractual relationship, in which case data is kept for the duration of that relationship plus the applicable legal, commercial and tax limitation periods (generally up to 6 years under Spanish commercial law).
  • Newsletter and commercial communications: kept from the moment you give your consent until you withdraw it, unsubscribe, or request that processing be restricted.
  • Once these periods have elapsed, your data will be deleted or, where applicable, anonymised or blocked for the period during which legal liabilities may arise.

2.2. Categories of data

The data collected falls under the category of identifying data: first and last name, phone number, email address, and, where applicable, postal address or company, as well as the IP address from which the relevant form is accessed.

3. Security measures

The Company has adopted the technical and organisational measures necessary to guarantee the security of personal data and to prevent its alteration, loss, unauthorised processing or access, taking into account the state of the art, the nature of the data, and the risks to which it is exposed, in accordance with Article 32 of the GDPR.

4. Data processors and service providers

In order to provide our services, your data is processed by the following data processors, under a contract that guarantees the confidentiality and security of your data in accordance with Article 28 of the GDPR:

  • Web hosting: the hosting infrastructure provider this website runs on.
  • CRM (customer and property management): our own, custom-built system, where enquiries and the resulting business relationship are recorded.
  • Form submissions and email delivery: forms on this website are processed through WordPress itself and the hosting providers own mail service, without involving third-party email marketing platforms.
  • Backups: automatic backups managed by the hosting provider, protected to the same standard as the rest of your data.

No other disclosures of data to third parties are made, except as required by tax, commercial or telecommunications legislation, or when required by a competent judicial or administrative authority. No international transfers of data outside the European Economic Area are made unless the relevant provider has the appropriate safeguards required by applicable law.

4.1. Social media and messaging apps

This website includes links and contact buttons to WhatsApp, Meta (Instagram and Facebook), LinkedIn and TikTok. Clicking on them takes you away from this website to interact directly with the corresponding platform, which acts as an independent controller for any data you provide it and applies its own privacy policy. In particular, if you message us on WhatsApp, that conversation is handled through WhatsApp (Meta), under its own terms. The Company does not control and is not responsible for any data processing these platforms carry out beyond this website.

4.2. Google Maps

The Contact page includes a button to voluntarily load a Google Maps map showing our office location. This map does not load automatically; it is only requested from Google servers when you expressly click the "Load Google Map" button. Doing so may cause Google to set cookies and process data from your device under its own privacy policy, unrelated to the Company. You can find more information in our Cookie Policy.

5. Your rights

Any data subject has the right to obtain confirmation as to whether the Company is processing personal data concerning them. Data subjects have the right to access their personal data, and to request rectification of inaccurate data or its erasure when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

Under certain circumstances, data subjects may request the restriction of the processing of their data, in which case it will only be retained for the exercise or defence of claims. They may also object to the processing of their data and request data portability, as well as withdraw their consent at any time, without affecting the lawfulness of processing carried out before that withdrawal.

5.1. How to exercise your rights

You do not need to systematically attach a copy of an identity document: the Company will only request additional information to verify your identity where there are reasonable doubts about who is exercising the right, and only to the extent strictly necessary.

5.2. Complaints to the Spanish Data Protection Agency

If you consider that the processing of your personal data does not comply with applicable regulations, you have the right to lodge a complaint with the relevant supervisory authority. In Spain, you can do so directly with the Spanish Data Protection Agency through its online complaints portal (www.aepd.es).

6. Consent for electronic communications

In accordance with Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, we will only send you commercial communications by email or phone when you have expressly ticked the independent consent checkbox to receive commercial communications on the relevant form. You can withdraw this consent and unsubscribe at any time through the link included in the form itself, or by writing to portals@novushabitat.es.
